1. Introduction

1.1. These Terms & Conditions govern the provision of services by Bluetick Chauffeur Services Ltd (referred to as the “Company”), registered at 47 Cromwell Drive, Slough, SL1 3ND, Berkshire, to users accessing the Service at www.bluetickchauffeurservices.co.uk and its subdomains (referred to as the “Site”) as described further in section 2 (referred to as the “Service”). By using the Service, you (referred to as the “User”) agree to these Terms & Conditions. This Agreement (referred to as the “Agreement”) becomes legally binding upon your first use of the Service.

1.2. By using the Service, you are considered to have accepted the terms of this Agreement without reservation. If you disagree with any provision of this Agreement, you shall not use the Service.

1.3. The Company reserves the right to modify this Agreement at any time without prior notice. The revised Agreement becomes effective when posted on the Site. By continuing to use the Service, you confirm acceptance of the revised Agreement. Users are encouraged to review the Agreement regularly. If you do not agree to the revised Agreement, you may not use the Service.

1.4. This edition of the Agreement is effective from March 23, 2024, until the adoption of the next edition.

1.5. Time frames specified in this Agreement are determined by the UTC+0 time zone unless otherwise indicated. Calendar dates are determined by the UTC+0 time zone.

2. Description of Service

2.1. The Service provides User access to data for searching private and other transportation service providers registered under Bluetick Chauffeur Service (referred to as “Carriers”).

2.2. Upon registration, the User gains access to a Personal Account containing User information, contact persons, personal settings, service requests, and other data. Designated contact persons appointed by the User may also access the Service through the User’s Personal Account.

2.3. Users can place Requests for private passenger transportation services in their Personal Account, specifying essential terms. Carriers may send Offers in response to Requests. Upon acceptance of an Offer, a Transportation Contract is formed between the User and the Carrier. Terms and procedures for cancellation and refund are defined in Section 10.

2.4. Prices for transfers, long-distance, and on-demand rides apply to start and destination addresses. Additional fees may apply for stopovers.

2.5. Hourly bookings begin at the pickup time and end in the pickup city area. Additional costs may apply for exceeding included kilometers or booking duration.

2.6. Agreed pickup times may be adjusted for airport or long-distance train station pickups based on arrival time deviations.

2.7. Users can choose from various vehicle classes based on regional availability. Bluetick may upgrade vehicle classes at no additional cost depending on availability.

3. Transport Safety and Consequences

3.1. Luggage and Animals:
– Maximum luggage capacity per vehicle is detailed in the Q&A. Additional luggage exceeding the car boot space may result in trip refusal and full booking fee charge. It is the User’s responsibility to ensure the chosen vehicle can accommodate the luggage.
– Animals other than guide dogs for registered disabled people may be accepted at the discretion of the Company, provided this is disclosed at the time of booking. The company reserves the right to refuse transportation of animals except guide dogs or other animals used by registered disabled people.

3.2. Child Restraints and Behavior:
– Users must specify the need for child restraints in the ride request, including the number and age of children and the type of restraints required.
– The transport of unaccompanied minors may be rejected by the Transportation Service Provider (TSP) as per regional legal requirements.
– Child seat details (age and height of the child) must be included in the booking for safety compliance. Failure to provide this information may result in the trip being canceled and fully charged.

4. Behavior and Vehicle Care

4.1. Users are responsible for the behavior of all passengers and must ensure compliance with this agreement. Passengers must wear seat belts and refrain from behaviors that endanger safety. Smoking is strictly prohibited. The chauffeur may refuse entry or terminate the agreement due to unacceptable behavior, with the full booking fee remaining payable. Users are liable for any damage to the vehicle or property caused by them or any passenger, including cleaning costs.

5. Vehicle Arrangements and Contingencies

5.1. The agreed vehicle type will be used whenever possible. In the event of a breakdown, efforts will be made to provide a replacement vehicle; otherwise, a full refund will be issued. The Company reserves the right to subcontract its obligations or rights. Users must treat the vehicle with care; any damage or excessive dirt may incur additional charges. Vehicle images on the website are illustrative, and actual vehicles may vary.

6. Booking, Cancellation, and Waiting Time

6.1. Online bookings must be made at least 4 hours in advance. If a booking is canceled within 24 hours from the start of the hire period, the Customer or booking agents will be charged 100% of the booking cost. Bluetick Chauffeur is not responsible for delays caused by circumstances beyond its control.

6.2. Cancellation charges may apply unless a cancellation is received before the chauffeur and car dispatch or in cases where short notice prevents accepting another booking. Account customers will be invoiced every two weeks or immediately after completing booked journeys unless alternative arrangements are made. Payment terms are net 14 days unless otherwise agreed upon.

6.3. Complimentary waiting time for airport, train station, and cruise terminal pickups is 60 minutes from the actual arriving time or pick-up time with buffer, with a maximum waiting time of one and a half hours. After 30 minutes of complimentary waiting time, if a passenger fails to show up, the chauffeur may leave, and the trip will be charged 100% as a no-show. Free 15 minutes waiting time is provided for pick-ups from all other destinations, with a maximum waiting time of 45 minutes, with any additional waiting time charged at £0.75 per minute. Additional charges may apply for extra stops.

7. Agreement and Licensing

7.1. The User may choose between Saver or Flexible access to their Personal Account, each offering different levels of service and support.

8. Payment Terms

8.1. After entering into a Transportation Contract, the User makes a prepayment of the Transfer Price to the Company, which is transmitted to the Carrier. Payment options are provided by the Company.

8.2. The Company does not store User payment data.

9. Miscellaneous

9.1. All payments made by a User under this Agreement shall be made gross, free of right of counterclaim or set off, and without deduction or withholding of any kind other than any deductions or withholding required by law; if a User makes a deduction or withholding required by law from any payment, the sum due shall be increased to ensure that the Company receives the full amount.

9.2. Users are responsible for any applicable taxes related to payments made under this Agreement.
